Two foreign workers looking at a sign that says H-1B visa or EB-3 Green Card program

EB-3 vs H-1B: The Winner For Trump 2.0

Immigration is a constant and evolving topic that Trump keeps front and center, and now the H-1B visa has been thrown into the spotlight – again. During his first term, Trump tried to eliminate the program, but this time, Elon Musk may be calling the shots.

Given the hyperbole, rhetoric, and campaign promises Trump made during the 2024 campaign, moving away from the H-1B and relying on a far superior option that already exists makes more logical and political sense for Trump 2.0—the EB-3 Green Card program.

The United States offers nearly 200 different visas, and all can be condensed into one of two categories:

  • Immigrant visas
  • Non-immigrant visas

The most often used American visa is the B2 visa—the Visitor Visa. The B2 is the US version of the tourism visa or entry visa, used by millions of foreigners annually to take vacations in the United States.

However, some people seek more than a relaxing week on America’s beaches. For those seeking to capitalize on the US employment market, a foreigner must either have work authorization or a Green Card.

Thousands of foreign workers have used the US H-1B visa program to acquire legal work authorization and monetize the US market by temporarily leasing their skills and talent to US corporations.

However, a far superior option exists that essentially eliminates the cost to the company, better maintains national security, and provides unmatched advantages to the worker—the Employment-based Visa-3rd Preference or EB-3.

The H-1B and EB-3 Visa Programs: A Comparison

The EB-3 and the H-1B are both categorized as work authorizations or work visas enabling a foreign worker to gain legal employment in the United States. Beyond that, there is not much similarity left, as these two visas differ significantly in:

  • Purpose
  • Eligibility criteria
  • Application processing
  • Flexibility
  • Benefits & advantages to the worker
  • Employer costs

With a more in-depth view, the resounding reasons why the EB-3 is superior to the H-1B becomes evident, including why the EB-3 should be the primary work visa program for Trump 2.0.

Our EB-3 Green Card program is a far superior option for both the worker and the United States.

The EB-3 provides a far better solution in terms of national security, US trade secrets and IP, fair play to the US professional, and a one-time solution that can be reused without any additional costs.

The H-1B gives temporary foreign workers privileged access to the competencies, insights, training, and high-paying jobs of US corporations, including their competitive edges over companies in the worker’s homeland.

These workers then return to their homeland with US training and insights but now need to offer those ‘competitor companies’ something in exchange for employment – what could that be?

The EB-3:

  • Creates a permanent US taxpayer
  • A legal resident who is now on equal footing with US citizens in the marketplace
  • Provides the spouse work authorization rights as well [2 workers for 1 application]

And, once the initial job ends, an EB-3 Green Card holder can simply go on to work another job that would otherwise need an H-1B worker without any additional costs, immigration issues, or negative impacts to US workers who also could compete for that role

If you are considering the H-1B program, now is the time to re-consider that choice and opt for the EB-3 Green Card – with a Green Card in hand, Trump 2.0 will be your biggest supporter.
